Fair Effective Enforcement

High Court Enforcement

High Court Enforcement

Your case can be moved to the High Court, if your County Court Judgement (CCJ) is not older than six years and worth more than £600. As a provider of enforcement services for Just – The Debt Enforcement Market Integrator, we will employ High Court Enforcement Agent, Mr. Christopher Badger. This enables us to direct an accredited and certified Enforcement Agent working under Mr. Badger’s supervision, to carry out the execution of the High Court Writ, to retrieve any money that is due to you.

Our Enforcement Agents will make every effort to obtain complete payment from the debtor, including all fees and interest. If for any reason this isn’t achievable and the claimant consents (however, there is no obligation to do so), the debtor could be offered the chance to work out a repayment plan. In this instance, a Controlled Goods Agreement shall be implemented.

When a debtor fails to pay the outstanding balance and has items that can be sold, our Enforcement Agents will seize such items and sell them at auction. All associated expenses will be applied to the debt.

There is a £66 transfer fee to the High Court, in addition to a £75 compliance fee plus VAT. These costs are due at the time of instruction but if the enforcement is successful, they will be added to the amount owed and collected from the debtor. If circumstances dictate that we are unable to collect the debt, these fees are non-refundable.

To commence the process, please click the link at the bottom of this page and download, fill out, and return the instruction form. The form displays additional information, including the return address.

Once the form has been completed, a representative of the High Court Enforcement Office team will review the information and enter your case onto the records system. After completing the paperwork that is required and obtaining your signature, they will mail the documents to the court. The High Court Enforcement Officer (HCEO) will receive a High Court Writ of Control, once the court has transferred the case up.

Issuing the debtor a Notice of Enforcement is the first step in the recovery process. The debtor is permitted 14 days to get in touch with the office and make payment. An Enforcement Agent will be assigned to handle the case for collection, if the outstanding amount is not paid or a suitable resolution is not achieved within this time period.

In contrast to other debt collectors, HCEOs and Enforcement Agents acting under HCEO instructions to carry out High Court Writs, possess greater authority. The chance of a full and successful recovery rises considerably as a result.
